Parking ticket with wrong state and got towed?
I got a parking ticket and got towed. I parked the night before a special event in New Orleans, and the temporary “no parking” signs were not up until after I had parked.
When I bailed my car out at the tow lot, the lady told me that the ticket was written for a LA plate, not my MD plate. She said I should contest on the grounds that the ticket was written for the wrong plate. Is this a better argument than my real one? Can I recover the towing fee?
The ticket should also have your car’s VIN in addition to the license number. I don’t know if the technical error of LA instead of MD on the ticket is enough to invalidate it.
You having parked before the temporary no parking signs went up probably does not matter, unless you parked less than 24 hours before the signs went up and your car was towed immediately. If yes and you can document that you parked before the signs went up then you should contest the ticket. To be clear, if you parked legally before there were > any < no parking signs, can document that, and your car was parked for less than 24 hours before being towed you may be able to recover the towing fee.
However, the temp signs usually go up several days before an event in the City of New Orleans and cars are only towed shortly before the event. The parking law does not allow the storage of vehicles on a public street (parking over 24 hours) so it is the owner's responsibility to keep track of their vehicle. If you parked on a Parade Route you are probably out of luck. Parade Routes are published in advance and there are signs (not just the temp signs) warning of "No parking 2 hours before and after any parade" even if you didn't notice them.
If you were towed from somewhere outside the City of New Orleans (ex. Metairie) then the rules & laws may be different.
